Introduction
It is our intention to protect your personal
information and this privacy statement describes how we intend to do that. This
Privacy Policy describes the principles and practices that apply to information
collected from users of our services on www.YellowCourtyard.com (our “Site”). As used in this Privacy
Policy, the term "Personal Information" means any information, recorded
in any form, about an identified individual, or an individual whose identity may
be inferred from the information. This includes, for example, name, e-mail and mailing
address and telephone number, billing and account information, and other information
incidental to providing the products or services offered on our Site.
BY SUBMITTING PERSONAL INFORMATION TO US, AND/OR
BY USING OUR SITE, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL
INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED
BY LAW.
If you do not agree with these terms, do not
provide any Personal Information to us. If you refuse or withdraw your consent,
or if you choose not to provide us with any required Personal Information, we may
not be able to provide you with products or services that can be offered on our
Site.
Minors (as defined under the laws of their
jurisdiction or residence) are not eligible to register for, use, or purchase the
Products or Services available on our Site. We do not knowingly collect Personal
Information from any Minor, and will not use this information if we discover that
it has been provided by a Minor.
Generally, unless you affirmatively choose
to make such information available to us by subscribing to one of four subscription
levels,
- We will not collect and use your information
without your knowledge and permission.
- We will not knowingly disclose your information
to third parties, except as provided in this Privacy Policy.
- We will allow you to view, correct or remove
your information.
- We will take reasonable steps to protect
the security of the information we collect from you.
Yellow Courtyard collects and uses the Personal
Information you provide through our Site at the time of your subscription. Our Site
also describes the choices available to you regarding our use of your Personal Information.
Although we will not share your name or email
address with any third party, unless you specifically authorize us to do so, please
be aware that if you do not permit us to share your name and other personal information,
you may not be able to subscribe to certain Explorer levels or receive the services
and benefits offered in connection with your subscription.
Sign-Up to Become an Explorer
We refer to individuals who subscribe for access
to our Site as "Explorers." If you apply to become and Explorer at one
of four levels through our online registration, we will use your Personal Information
to follow up with you about your application and to assist you in taking advantage
of other services and programs offered on our Site. Enrollment at the Bronze Explorer
level, the basic enrollment level, will require that you provide us with your name
and email address, as well as other information set forth in our online application.
We will use that information only for the purpose of creating any user profile and
providing you with a user name and password used to access your application and
any other services we offer. We will use the information in your application to
provide you ongoing services and to communicate with you from time to time.
If you subscribe for our MRA Program, including
the emergency medical card, by signing up at either of the Silver, Gold, or Platinum
Explorer levels, you will be asked to provide detailed personal health information
and be given the opportunity to provide us with copies of your healthcare records
for storage in accordance with the terms and conditions of that program. Information
and documents you provide to us under that program will, upon your specific authorization,
be used and disclosed to third parties, including other healthcare providers involved
in your treatment and care. Your information will also be used in connection with
certain research studies we may undertake from time to time regarding the health
of our Explorers. This information will be completely stripped of all personally
identifying information so that any data used cannot be traced to you. We encourage
you to review the terms and conditions of the respective Explorer subscription levels
for additional information on the use of your Personal Information.
Occasionally we conduct customer satisfaction
surveys so that our Explorers can provide feedback on their experience using our
Site and other services and programs. Contact information requested in these surveys
is optional. We use the survey responses to improve our programs and services to
our Explorers. We also occasionally share this survey data with third parties, but
only in aggregate form, i.e., without disclosing Personal Information or identifying
individual Explorers.
From time to time we will also offer you the
opportunity to receive information on various health-related products or services
offered by on our Site and by other third-parties. We will not share your Personal
Information with these third parties, other than service providers, unless we have
your explicit permission to do so. Your permission, however, may be assumed by your
requesting access to or enrolling to receive these services.
We will use information submitted through our
online registration to analyze the characteristics of our Explorers, in order to
improve our services to them. We will occasionally utilize aggregated statistics
about our Explores in conducting research and preparing reports made available in-house,
to third parties, or to the general public. These reports will not identify individual
Explores.
If you wish to sign up as an Explorer, or to
simply obtain information about Yellow Courtyard programs and services, click on
our click on our About YC page. We will collect your name, email address, phone
number, and additional information, which we will use to contact you about your
request, to assist you in your Explorer enrollment or to follow up with you about
the programs and services in which you have expressed an interest. We will not share
the information you provide with third parties without your permission.
You can ask us to delete the information you
provided on our newsletter or info request pages by emailing us at unsubscribe@yellowcourtyard.com.
Explorers
If you are currently signed up as an Explorer,
you can proceed to explore the world of Yellow Courtyard or upgrade or renew your
Explorer status by clicking on My Account, under the My Courtyard tab. If you provide
information on our Contact Us page, for example, because you are requesting information
about additional programs offered through our Site, we will use the contact information
you provide there to respond to your request. We will not share this information
with third parties without your permission.
How to access, modify or delete your Personal
Information
We endeavor to ensure that Personal Information is as accurate,
complete, and current as necessary for the purposes for which we use that information.
We encourage you to visit My Account under the My Courtyard tab to review your Personal
Information.
You can access your Personal Information by clicking on
the My Account under the My Courtyard tab, update it, correct it, or modify it,
as necessary.
If you request that we remove all of the Personal Information
stored on our Site, we will promptly do so, to the extent possible. Once required
Personal Information is removed, however, you will not be able to use many of the
services available on our Site unless you re-register.
Please remember that our healthcare records storage program
is subject to certain Terms of Service and right to access, modify, or delete those
records are subject to those Terms of Service.
Cookies
A “cookie” is a small text file that a Web
site can place on your computer's hard drive in order, for example, to collect
information about your activities on the site or to make it easier to use certain
site functions. The cookie transmits this information back to the Web site's
computer. Many users do not know that "cookies" are being placed on their
computers when they visit Web sites. If you want to know when this happens, or prevent
it from happening, you can set your browser to warn you when a Web site attempts

We use cookies on our Web sites in the following

When you respond to a survey that Yellow Courtyard
posts from time to time, we use a cookie to make it easier for you to use the survey
form, and to ensure that we do not receive duplicate survey responses from any one
respondent.
When you register to become and Explorer, we
use a cookie to enable you to navigate easily through the application process.
We also use cookies to analyze how visitors,
in the aggregate, use our Site, in order to make our Site as useful as possible
for them. We do not use cookies to collect or store personally identifiable information.
Information automatically collected by our
Site
Our servers automatically collect certain non-personally
identifying information, such as your computer’s IP address, the type of browser
in use, and pages viewed, when you visit our Sites. We use this information to understand
how visitors navigate through our Sites, to enhance your experience while using
our Sites, and to make the materials we post as valuable to visitors as possible.
We do not link this information to personally identifiable information.
Personal Information Sharing
We will share your Personal Information with
third parties in the ways that are described above in this Privacy Policy. We will
also share your Personal Information if we are required to do so by law, or if we
believe that doing so is necessary in order to conform to the law, cooperate with
law enforcement agencies, comply with legal process served on Yellow Courtyard,
or otherwise protect Yellow Courtyard’s legal rights. From time to time we employ
service providers to perform various functions involving Personal Information on
our behalf. These service providers are prohibited from using your Personal Information
for any other purpose.
Access to your Personal Information
Yellow Courtyard will provide you reasonable
access to your Personal Information, within 30 days of your access request. Your
access may be subject to certain Terms and Conditions applicable to specific services
provided on our Site. If we cannot provide access within the 30-day period, we will
tell you when we will provide access. In the unlikely event that we cannot provide
you access to this information, we will explain why we cannot do so. To request

Providing security for the personal information
